Is a trading bot the same as financial advice?
The regulatory line in plain English
US regulation broadly distinguishes between publishing tools or general information and giving individualized investment advice for compensation. The second category triggers adviser registration, fiduciary duties, and supervision. Software vendors live in the first category — as long as they actually behave like it.
The practical test: does the product tell you what to do with your particular money? A bot executing a fixed, disclosed ruleset that you chose to deploy is your decision, automated. A service that evaluates your situation and steers you into positions is functioning as an adviser, whatever its marketing says.
Why honest vendors stay firmly on the tool side
We build trading software, and we hold the line deliberately: we never tell anyone what to buy, we make no predictions, and the desk's written rules are readable by the operator who runs them. The operator decides whether to run the desk at all, on paper or live, and holds every switch.
When you evaluate any bot, read the vendor's language. 'Our software follows these rules, you decide whether to run it' is a tool. 'Our AI knows what you should be holding' is advice-shaped marketing from someone who almost certainly is not registered to give it — which tells you about their relationship with rules generally.
- Tool: fixed disclosed rules, operator decides, no personalization.
- Advice: individualized recommendations, a regulated activity.
- Red flag: advice-shaped claims from a vendor with no registration.

More questions people ask
Does automating my trades create advice?
No — automating your own decisions in your own account is not advice. The regulated category is other people directing your money or recommending positions specifically to you.
Are robo-advisers the same as trading bots?
No. Robo-advisers are registered investment advisers using automation to deliver a regulated advisory service. Trading bots are execution tools that stay outside that relationship.
Is anything on this site investment advice?
No. Everything we publish — including our tape and these answer pages — is general information about how trading software works. We never make recommendations about your money.
